What it is
The Alimony Fund is a permanent budget fund created by law and managed by the Ministry of Family Care and Demography. It does not cancel alimony or replace a court decision: it temporarily pays the child while collection from the person owing support has not succeeded in full or in part.
When the right arises
The law ties the payment to a child who is a Serbian citizen and an enforcement creditor in proceedings for statutory support. If more than two months have passed after the enforcement decision was served on the debtor and collection has not been completed in full or in part, the public enforcement officer must ask the creditor whether they consent to temporary support from the fund. The reply deadline is eight days.
How the payment is made
Once consent is given, the enforcement officer promptly sends the ministry a notice, the enforcement decision, and the enforcement instrument through the Justice Ministry portal. The fund manager must decide on payment and transfer it to the creditor's account within 15 days of receiving the notice. The payment covers time after that decision and cannot exceed the minimum maintenance amount under family law.
What happens to the debt
The debtor's obligation does not disappear. Amounts paid by the fund are recovered in the same enforcement case after the child's claim is satisfied and are paid into the budget. If they are not recovered there, Serbia may seek them from the debtor with interest; that claim does not expire. The enforcement officer must also check every month whether the debtor has acquired assets that can be enforced against.
Current status
The ministry's official report for January 1 to June 30, 2026 records 36,368,505.25 dinars spent on temporary support; the 2026 budget allocated 100 million dinars for the fund. On July 25, N1 reported Minister Jelena Žarić Kovačević's statement that 889 children receive timely support and that 54,209,260 dinars have been paid since the state guarantee began. These are figures from different reporting cutoffs, not an individual confirmation of a family's eligibility.
The next practical question
The essential question is whether enforcement proceedings already exist and when the enforcement decision was served on the debtor. If collection has not progressed for more than two months, the next procedural step should come from the public enforcement officer, not a separate fund application.
